Abstract

John Cannaday represents that "he purchased a negro woman slave of a certain Cornelius Crow ... for which your orator agreed to pay the sum of $275 and executed his promissory negotiable note for that sum payable 4 months after." When he purchased the slave, Cannaday believed her to be healthy and a good value; however, "scarcely had your orator obtained possession of the slave, when he found to his no small surprise that she was, & had for a considerable time before the purchase, been diseased, unsound, unhealthy, & of no value ... that instead of her being of any service she has been ever since the purchase & is likely to remain, a continual charge to your orator." Cannaday conceives "himself grossly taken in by the fraud and imposition practiced upon him in the premises," and "has instituted an action to recover damages" from Crow. In the meantime, he prays that "Crow may be restrained from negotiating or in any manner transferring the said negotiable note" and "that the President Directors &c of the Bank of Virginia ... be restrained & enjoined from protesting the said note until the further order of the Court."

Result: Injunction granted; dissolved.
