Abstract

Following the death of her husband, Cynthia Davidson entered into an agreement with her father-in-law, James Davidson, who promised to provide her with a house and to "cloath and maintain and school" her seven children if she gave him her furniture, her claim to rents on some land, and her claim to a slave named Felix. He later promised that upon his death he would devise Felix or a female slave to his grandchildren. However, James failed to live up to his end of the bargain. He refused to accept three of the children, and, after six months, he drove the others out, threatening "to horse whip them if they returned." James has since died, leaving his widow Peggy and their son Goldman as executors of the estate. They now plan to sell Felix, despite the promise made to Cynthia. Cynthia, her children, and her present husband pray that the executors be made defendants to this suit. They further pray that the transfer of the slave to James Davidson be canceled and that Felix be returned to Cynthia's family. In an addendum to the bill, the petitioners state that Felix has been sold to Louis B. Dulany, who the petitioners pray may be restrained from leaving the county with Felix until the suit is settled.
