Abstract

Tandy Bowcock gave his daughter, Susan Bowcock Davis, a "family slave" named Sally as a wedding gift. Later, Bowcock decided to sell Sally's mother, and in an attempt to keep mother and daughter together, he exchanged Sally for "a negro boy named James," also "a family slave." The sheriff later confiscated James for one of Bowcock's debts, and Susan's husband, Thomas Davis, seeks an injunction to halt James's sale. Davis contends that "the owner of a Slave, especially such an one as this, who is a family slave, is entitled to the interposition of a court of Equity, to prevent the sale."

Result: Partially granted; dismissed.
