Abstract

In his 1827 will, the late Edwin Lanier emancipated his slave named Jane and bequeathed to her a horse, cart, furniture, a barrel of corn, one hundred pounds of pork, and two hundred and fifty dollars in cash. He directed that she should be permitted to live in her house on the plantation for nine months, at which time she should move to Ohio "or any other free state she wishes to go to." Jane informs the court that she has been "constantly refused the Legacy which was decreed to her." The will's executor, Thomas Hunt, claims that he has "fully administered" the estate and has nothing "in his hands" with which to pay her legacy. Jane argues that the estate's real estate is liable for her legacy and that the lands "in the hands" of Lucy Lanier, Edwin's widow, and his children should be made subject to her demand.
