Abstract

Mary Pope laments that after a few years of "agreeable" conjugal life with her husband, Peter Pope, she has now "cause for much and grievous complaint." Although she has been a "dutiful wife, kind obedient, and affectionate," she has not been able to secure a "safe asylum" for herself and her four children. Having suffered physical mistreatment at the hand of her often-intoxicated husband, she confides that "he has repeatedly turned her out of his house and kicked her from his doors, forcing her to pass the night in the woods at inclement seasons of the years." Pope avers that she and her children are left "unprotected" and "unprovided for" and that she "entertains no hope of a reconciliation." The petitioner therefore prays to receive "the payment of such a sum out of his estate ... as may be necessary for the maintenance of herself and children." She also seeks a restraining order to prevent her husband from removing his property to Texas.
