Abstract

Howell Edmunds, the executor of the late Nicholas Edmunds's estate, “is advised there is error” in the court's judgment in 1839 that granted Hannah and her three children their freedom. During the trial, Nicholas's counsel asked the judge to instruct the jury that the plaintiffs would have to show that Nicholas "assented to the legacy under which they claimed their freedom." The court refused this request and the jury ruled in favor of Hannah and her children. Edmunds claims that there was an "error in the said judgment, in this that the court ought to have given the instruction asked for by the defendant's counsel." Therefore, "for this and other errors apparent upon the face of the said record your petitioner prays for a writ of supersedeas to the said judgment to remove the same to this honorable Court, to be reversed and annulled."

Result: Granted.
