Abstract

John Tynes, a "free negroe," asserts that Peggy Blair, "mulattoe & free," is indebted to him for $32.76 as well as "for work and labour, care and diligence, and divers materials & necessary things, wood &c in and about the said work." Tynes charges that he delivered wood, shingles and other merchandise to Blair for which she "faithfully promised to pay to said plaintiff ... whenever she should be thereunto afterward requested. The petitioner avers, however, that “the said Peggy Blair, not regarding her said several promises and undertakings, has not, altho' thereunto often requested, as yet paid to the said plaintiff, the said several sums of money or either of them, or any part thereof, but so to do, has hitherto wholly refused & neglected, & still refused & neglected, & still refuses & neglects, to the damage of the plaintiff $50 & therefore he bring[s] suit."

Result: Granted.
