Abstract

Hannah Daniel states that her father, John Rogers, died in 1788, bequeathing his estate to his wife during her life or widowhood. Following her death or marriage, his property and slaves, except his "land, gun bridle & saddle," would be distributed among his surviving children. When the widow died, a daughter Mary received a female slave who had eleven children. Mary has since died, leaving as heir her widower, John Kern. As the only surviving child of the said Rogers, the petitioner believes she is entitled to the slaves left to Mary by their father. However, Kern "refused & still refuses to deliver" the slaves to her nor will he "account with her for their hires and profits, but claims them as his own property acquired by virtue of his intermarriage with the said Mary." Kern has already sold a slave named George and exchanged the slave named Charles, and Daniel has "reason to fear" that Kern will remove the others "beyond the reach of any process of said court." Daniel prays that the court "will enjoin & restrain" Kern from "disposing in any manner of the said slaves" and that he may be required to enter into a bond to ensure "the safe keeping of said negro slaves." If Kern should refuse to enter into such a bond, Daniel prays that the sheriff will take the slaves into his possession.

Result: Injunction granted; dissolved.
