Abstract

William C. Higgason claims "that by the will of Elizabeth Martin decd. who was the great grandmother of your orator ... a negro man named George was ... left to one Thomas M Herndon, in trust to take and receive the hires and profits of the sd. slave & apply them to the support schooling and maintenance of your orator till he should arrive to the age of twenty one." Higgason charges that that Herndon "has never qualified or taken upon himself any of the duties of sd. trust, but has hitherto neglected ... the sd. capacity. That consequently your orator has never recd. any of the hires or profits of the sd. slave George ... that he is now in great want of the sd funds ... Your orator is informed that the sd negro has been hired out for one or more years, by Abraham Shepherd Jr. who qualified as the adr. of the sd Elizabeth Martin, and that he has now in his hands the hire of sd slave ... Your orator prays the appointment of William Catlett ... as the trustee in stead of the sd. Thos M Herndon ... and that the sd Shepherd be requd. to state the amt. of money ... received by him for the sd negro since your orator became entitled to the same by will."
