Abstract

Elvira and Isaetta Borden and their husbands state that in 1825, Mary Nally "conveyed in trust, to William Nally a negro girl slave Aggy, and the future increase of said slave, for the use and benefit of her daughter Mrs Nancy Borden wife of William Borden ... for and during the life of Mrs Borden, and after death the said slave and her increase to pass in remainder to the five children of Mrs Borden, to wit, Eliza, Mary Ann, Elvira, Isaetta, and Emily ... Aggy has had five children, one of whom is dead; the remaining four being named Caroline, Phil, Dinah & a younger one whose name is unknown." According to the terms of the trust, Aggy's daughter Caroline has been delivered to Mary Ann Borden and her husband in Mississippi; the other four slaves remain with Nancy and William Borden. Now, the Bordens "are about to remove from Virginia to the state of Missouri and intend, unless prevented, to carry along with them the said slave Aggy and her said three children ... if permitted to carry them to the state of Missouri, ... it would be extremely doubtful whether your orators and oratrices would ever again be enabled to get possession of the sd slaves." Therefore, the petitioners pray that their parents, sisters, and sisters' husbands be made parties to this suit and that they be enjoined from removing the slaves from Virginia until this dispute is settled by the court.
