Abstract

Mary Duty complains "that two Executions issued upon judgments ... against William Wagstaff the one in favour of William T. Z. Finch Richard C. Puryear and John F. Finch merchants ... for the sum of $204.54 ... and the other in favour of John F. Finch and Richard C. Puryear ... for the sum of $94.93 ... which have been levied by the Sheriff of Mecklenburg upon a negro girl Harriet the property of your complainant and then in her possession. For your Complainant avers that before the rendition of the said judgments ... She purchased the said slave of the said William Wagstaff for the sum of three hundred and five dollars ... That the said slave passed immediately into her possession and so remained until she was Taken by the Shff under the executions aforesaid ... the said slave will be sold by the Shff on Monday the 18th day of December next .. which is contrary to Equity and conscience ... The said slave Harriet being a family servant has peculiar value in the Estimation of your Complainant and the price for which She would sell would be most inadequate Compensation to Your Complainant for the loss of her." Therefore, Duty prays that the defendants "and all other persons be enjoined and inhibited from selling the said slave until this matter can be further heard in this Court."
