Merchants trading under the name of White, Tardy & Irvine seek payment of a debt incurred by Annzoletta Saunders. They relate that they "furnished divers goods wares and merchandize" to the said Saunders, for which $167 is owed. Noting that Annzoletta's husband, David Saunders Jr., is insolvent, the petitioners inform the court that Annzoletta and her children are beneficiaries of a trust estate that includes a house and lot in Lynchburg and several slaves. They further charge that David's father recently died and "thereby devised a certain portion of his estate ... in trust for the support and maintenance of the said David Saunders Jr his wife and children" during their lives. The petitioners attest that the property in trust for Annzoletta as well as "this property so conveyed or devised by the said will in trust as aforesaid, and the proceeds and profits thereof are liable to the payment of your orators said debt." They therefore pray "that your Honor will direct a sale of so much of said trust property as will be sufficient to pay your Orators said debt interest and costs."
Result: Dismissed.
