Abstract

G. G. Johnson seeks an injunction to restrain John Sturdivant from selling a slave named Tom. Johnson submits that he borrowed $300 from the said Sturdivant in 1849 and "executed to him a bill of sale, absolute on its face, for a negro man named Tom." He further points out "that it was expressly understood and agreed that it was to be held only as an indemnity." The petitioner now reports that Sturdivant informed him "that unless your orator ... promptly refunded to him the amount he had paid he would make sale of the slave Tom conveyed to him as aforesaid for his indemnity." Johnson relates that Sturdivant made good on his threat and "your orator was compelled to submit to the injustice and injury of a sale of the negro to pay a debt to a man owing him at least 5 or 6 times as much or to apply for the protection of a Court of Equity." Having won an injunction, Johnson avows that Sturdivant still "persists in his purpose to sell the said slave and thus compels your orator to resort again to the Court for protection." He therefore prays that Sturdivant "may be enjoined and restrained from making sale of the said negro Tom until the further order of the Court."
