Abstract

Henry S. Kane seeks a partition of a slave family among himself and the minor grandchildren of the late Ann Richeson Coghill. Kane relates that Jesse Richeson conveyed Betsy and her child Fanny to George W. Rogan, "in trust 'for the separate use and benefit of the said Ann Coghill' and her children. Kane claims that Rogan moved into the Coghill home after his wife died and "in shameful abuse of the privileges extended to him as one of its inmates ... basely seduced the said Mary Coghill, the sister of his, the said Rogan's, deceased wife." He reports that Mary became pregnant and she "was delivered of a child -- the infant was found dead with such marks upon it as led to the suspicion, that its death had been produced by violence," deeming that Ann and Mary "(doubtless to hide the shame and disgrace which had befallen the family and especially the unhappy girl) had perpetrated the act." Kane explains that they employed him to defend them in court, "which he did with success." Shortly afterward, Kane cites that Ann and Mary sold him the slaves and that Rogan brought suit against him to reclaim them. Kane admits that Rogan's children are entitled to a share of the slaves since their mother had an interest in them. However, he fears that Rogan will sell the slaves before the dispute is settled. Kane asks for an injunction to prevent the sale or disposal of the slaves until they can be divided between the children and himself.
