Henry Elliott, a free person of color, wishes to nullify a deed executed by his late mother, Mary Elliott. He reveals that his mother "for many years preceding her death was afflicted with blindness and her mental faculties were so much impaired by age and other causes as utterly to incapacitate her for attending to business of any kind and indeed rendered her entirely imbecile." He further asserts that while in this condition "the said Mary or Mollie Elliott executed a deed ... whereby she conveyed to a certain Robert C. Traylor ... a house and lot ... worth several hundred dollars and also a female slave named Lizzy worth about $150 ... for the future consideration of his having promised and bound himself to support her during the remainder of her life." Contending that Traylor "fraudulently took advantage of the infirm condition" of his mother, Henry Elliott prays that the said Traylor "may be decreed to deliver up the [deed] to be cancelled, and also to deliver up the possession of the property conveyed by said deed, to your orator."
