Sarah Jane Leigh Carter reports that her father, the late Paschal G. Leigh, bequeathed, "in trust for the use and benefit of his said Daughter Sarah Jane Carter and her children," a tract of land and "7 negroes, to be worked upon the land, or hired out, as may be more conducive to the welfare of his said Daughter." She explains that he further specified that none of the trust property should "be held liable for any debt 'now existing, or which may hereafter exist, against the present or any future husband of his said Daughter.' " Carter complains that neither her husband nor Francis Wooten, Leigh's designated trustee, agree "to act as Trustee." Sarah Jane Leigh Carter prays "that your worships will appoint some fit and discreet person as Trustee to take care of and manage the said Trust Estate, agreeably to the will of her father."
