Abstract

John Oyler and William T. Anderson, former business partners, report that "they hired of one Richard G. Morriss several negroes ... for the aggregate sum of $490 to work in their Tobacco Factory for the year 1855." They cite that before their note became due "they were notified by one Betsey Miller ... not to pay over the said note or any part thereof to the said Morriss that she laid claim to the same." They explain that Miller contended that Morriss had obtained the slaves "by fraud & collusion" and therefore had no right to claim the profits of their hires. As a result, Oyler and Anderson note that they did not pay Morriss, whereupon he obtained a judgment against them. They affirm "that they have no interest whatever in the subject of controversy -- that it is immaterial with them to whom the money shall go." They point out, however, that an execution has been issued and their property is in danger of being levied for nonpayment of the hire. Noting that they "are ready & anxious to pay the sum," the petitioners ask that Morriss be "restrained from further proceedings on the Execution aforesaid" and that the court direct disposition of the money owed.
