Abstract

James H. Street seeks an injunction to stop the sale of a slave girl named Amanda. Street notes that "he had placed his sister Ann C. Smith, wife of James A. Smith in possession of [a] negro girl (Amanda) ... not worth more than her board and clothing" in 1851. He later hired Amanda out to his sister "for the year 1855 for the sum of twenty five Dollars." The petitioner informs the court that the failed business attempts of James Smith and his ensuing insolvency have resulted in a levy "upon the negro girl Amada the property of your Complainant which said negro is now advertised for sale to satisfy the Execution." Avowing "that the said negro is his absolute property," and that "she could not with Truth be said Ever to have been in the possession of James A Smith," the petitioner prays that "your Honour will Injoin all further proceedings under the said Execution ... and that your Honour will Direct the Delivery of slave Amanda to your Complainant."

Result: Partially granted; dismissed.
