Abstract

Bryant Day, a free man of color, seeks a separation from "his wife a free woman of Colour named Mary Jane." Bryant asserts that "he has been kind, affectionate and faithful ... and that he has done all that a man of his station and Position in life can do to merit a return of affection, duty and faithfulness." Confessing that the said Mary Jane "has been unkind, devoid of affection," the petitioner reveals that his wife is "frequently drunk and living in most wanton violation of every marriage requirement, living in constant and open adultery." Day prays "that your Honor would decree a Separation between them from the Bond of Marriage," as "he has been "wofully disappointed" in his marriage.

Result: Dismissed.
