The heirs of the late Sally Holland, widow of Thomas Holland, inform the court that she held a life estate in two hundred acres of land and "held about eighteen or twenty slaves for her life" at the time of her death in 1861. They assert "that the said land and slaves are now subject to partition and division amongst the children of the said Thomas Holland who are living now, and the heirs distributees devisees legatees and assignees of those of his children who are dead." Of the opinion "that partition in Kind cannot be had either of the said lands or slaves," the petitioners surmise that "it will be necessary to sell both in order to make partition." They therefore pray that the "slaves be sold and the money arising therefrom divided amongst the parties entitled thereto according to their respective rights."
