Abstract

Fifty-five-year-old Elizabeth A. Bailey seeks a divorce from sixty-three-year-old Richard C. Bailey, her husband of eight years. She cites that Richard abandoned her five years ago "without any good and sufficient cause." She further reports that when she married Richard she owned "five or six slaves." Noting that "of course her slaves have been liberated and lost to her by the results of the war," the petitioner points out that "the hires and profits from this source have been entirely cut off from your oratrix." Being "advised that a period of 5 years having elapsed since she was willfully abandoned and deserted by the said Bailey," Elizabeth asserts that "she is entitled to a divorce from the bond of matrimony and to a restoration of all her original rights of property." She therefore prays "that the court will grant to your oratrix a divorce from the bond of matrimony" and that "the court will restore to your oratrix her rights of property."

Result: Dismissed.
