Abstract

Isaac Whittington died 7 January 1852. In his May 1851 will, Isaac declared, "I desire all of them [his slaves] that are of the age of twenty one shall be permitted to go free ... either by emigrating to Liberia or any other state and should my woman Leanna chose to go she shall be permitted to take her children that she now has or may have with her but should she remain in this state from choice her children at the age of fifteen to be bound out to learn some good trade until they are twenty one years of age if Boys and eighteen if Girls." He also stipulated that "should any or all of my slaves desire to remove at any time they shall be permitted so to do and take their children with them." On 3 January 1852, Isaac revoked "all and every legacy bequeathed his will except the provisions thereof respecting his slaves." Ned, the plaintiff, charges that William Whittington, administrator of Isaac's estate, collected and kept his hire from 1851 through 1854. Ned sues for his freedom and his said hire.
