Paul Motzenbecker seeks an annulment of his marriage to Ophelia Crovil. Motzenbecker represents that he married Ophelia in 1849, under the impression that she was white. Motzenbecker points out that, according to article 95 of the Civil Code, his marriage is a “nullity and void.” However, because his marriage was celebrated “in the manner and with the formalities required by law,” he needs the help of a competent jurisdiction to have his marriage decreed null and void. He prays for an order directing Ophelia Crovil Motzenbecker, his wife, to appear and answer his petition and to declaring his marriage void.
