Abstract

The six children and the widow of the late Adolphe Hebert seek the return of his estate's slaves. The petitioners represent that a slave named Melite "was received" by their father, Adolphe Hebert, from the succession of his father, Jean Baptiste Hebert. Melite and her five children are currently in the possession of Francis Williams who "claims them as his own property" based upon "a pretended adjudication made to him by Enos Hebert administrator of the succession of Adolphe Hebert. The heirs claim that on 16 April 1850, the day of the estate sale, Enos Hebert adjourned the sale early and then, "immediately after every one of those deserving to purchase the said slaves except said Williams had left," he sold the slaves "illegally" to Williams for $1,450. The petitioners pray that the court nullify Williams's bill of sale "and that they be decreed to be entitled to and have possession of said slaves." They further pray that Williams be ordered to pay them $2,000 in hiring fees for the slaves in compensation for the time they have remained in his possession.
