Summary

Indenture, return of property from a Marriage Contract Trust. Back in 1818-19, Mary L. Pugh was preparing to marry John S. Smallwood. In order to keep her property separate from his after the marriage, she transferred a 520-acre parcel of land and many enslaved people to a Trust administered by William Pugh and Peyton R. Turnstall(?). By 1844, John Smallwood had died. William Pugh has also died, and his estate administrator is Thomas J. Pugh. Peyton Turnstall has died, and Thomas J. P. Smallwood is his estate administrator. Mary L. Pugh Smallwood wanted the enslaved and other property returned from the Trust to her personal control, and obtained a judgement in Bertie County Court of Equity, Spring Term 1844. The current document specifies the return of property rights, including the enslaved, to Mary L. Smallwood. The document doesn’t specify names of the enslaved who went into the 1818-19 Trust, but they “and their increase” over the 26 years now number over 30. Listed by name are: Hasty, Moses, Lewis, Nelly, Lazarus, Jane, Panthena, Minerva, Andy, David, Aaron, Milly, Maluna (Malvina?), Pleasant, Caroline, Little Milly, Abraham, Lorenzo, Knowledge, Sarah, Clerry (Clessy?), Judith, Fanny, Madison, Adolphus, Benjamin, Matilda, Nancy, Maria, Matona, Polly, Lucy and Lewis. The clerk was inconsistent in his use of commas, so some of the enslaved may have had two names, but I logged each as an individual. The document was signed May 14, 1844, presented in Court May 1844, and registered May 20, 1844.
