Deed of Trust. Evander McIver owes over $1100 to five creditors. Benton Clemmons is security on at least one of them. To guarantee payment and protect Clemmons from financial liability, McIver places in Trust with Junius S. Clemmons “…four Negroes (viz.) Betsey, Charlotte, Wesley & Nancy…” along with livestock, farm equipment, furniture, crops in the field, etc. No further information about the enslaved, but Betsey was placed in a different Trust at NC.DAI.6.189.1, and Betsey, Charlotte, Wesley and Nancy were placed in a Trust at NC.DAI.6.191.1. We know from the earlier documents that Betsey is 36, and Charlotte is Wesley’s mother. If McIver does not pay his debts, Trustee Junius Clemmons is authorized to sell the enslaved and other listed items to make payment. The enslaved will stay with McIver until / unless the Trustee needs to sell them. The document was signed March 31, 1838, presented to the Clerk of Court and registered on April 2, 1838.
