Summary

Marriage Contract. Mary A. Swain and Lewis T. Thompson intend to marry, and this agreement is designed to keep the assets Mary brings into the marriage separate from those of her intended husband. To accomplish this, Joseph Jordan pays $5 to become trustee for Mary’s property, which includes 1000 acres of land and “undivided interest in twenty-eight slaves, being all the slaves in which she has undivided interest as the next of heir of her father or any deceased brother or sister.” (Mary’s father is Thomas Bond.) The enslaved are not named. Joseph Jordan is to manage the land and slaves for the benefit of Mary Swain, including the power to sell any part of the land or slaves for investment in “good and safe securities”. Mary’s assets are to remain “free from the debts or contracts of her said intended husband”. In the event of Mary’s death, her estate would pass to any children from the marriage, and if there are none, to whoever she names in her Will, and if no Will, to Lewis Thompson. Joseph Jordan is allowed to appoint another Trustee if Mary Swain and Lewis Thompson move to another state or other “remote” location. Signed June 25, 1856.
