Deed of Trust. Evander McIver borrowed $328 from Hiram Phelps, acting as Guardian of the heirs of Thomas Cooper, deceased. John Clemmons and Benton C. Douthit are securities on the loan. To guarantee payment and protect his securities from financial liability, in this document McIver transfers to John W. Eakels “…A Negro Woman by the name of Betsey thirty six years old the 20 June 1838…”. No further information about Betsey or her relationships, but this is a rare situation where we know the exact birth date of an enslaved person. If McIver does not pay his debt by December 26, 1838, Trustee Eakels is authorized to sell Betsy and make payment. The document was signed and presented to the Clerk of Court on March 13, 1838 and registered on March 14, 1838.
