Abstract

Deed of Trust. Evander McIver owes Benton Clemmons $1202.88, some of it in “book accounts”, some of it “balance of tuition receipts”. To guarantee payment, McIver puts in Trust with Peter C. Clemmons two acres of town land “by the academy”, several horses named and identified by lineage “…together with my Negroes Betsey Charlotte & son Wesley and Nancy…”, livestock, furniture, carriages, etc. No further information about the enslaved in this document, and I will assume Charlotte and Wesley are mother and son, and Nancy is not part of that family. Betsey (age 36) was listed in a previous McIver Trust at NC.DAI.6.189.1. If McIver does not pay his debt, Trustee P.C. Clemmons is authorized to sell the enslaved and named items to make payment. The document was signed March 15, 1838, presented to the Clerk of Court on March 16, 1838 and registered on March 17, 1838. (Abstractor’s note: Davidson County Deed Books 6 and 7 were microfilmed By the North Carolina Dept. of Archives and History, on one roll of microfilm (December 9, 1966).
