Abstract

Deed of Trust. The firm of Newsom & Spence (Allen Newsom and Daniel Spence) owe the firm of Humphreys & Gaither (James P. Humphreys and Sam Gaither) $1050, by a note due March 17, 1839. Humphreys and Gaither are also securities on a bond from the Bank of Cape Fear for $400. To guarantee payment of the debts, the Newsom & Spence firm places into Trust with George Riley “…all of our stock of goods or merchandise that we now have on hand with our Book accounts and notes that belong to the firm of Newsom & Spence…”. Allen Newsom, as an individual, also puts into the Trust a 200 acre “Plantation known as the Daniel Tract” and “…a Negro girl by the Name of Betty…”. Newsom states a couple of times that Betty is his personal property, and not part of the Newsom & Spence firm, but there is no further information about Betty’s age or relationships. If Newsom & Spence do not pay their debts before March 17, 1843, Trustee Riley is authorized to start selling assets, including Betty, to make payments. The document was signed February 13, 1841, presented to the Clerk of Court February 13, 1841 and registered February 24, 1841. (Abstractor’s note: Davidson County Deed Books 6 and 7 were microfilm
