Abstract

“Mortgage” or Deed of Trust. Elizabeth M. Kelly owes Anderson Ellis $1476.75, due in about three months, and David F. Caldwell is Security. Kelly places in Trust with Caldwell 18 enslaved people, including three mother and children groups. Kelly will “keep possession” of the enslaved, but if she defaults on her debt, Trustee Caldwell is authorized to sell as many of the enslaved as necessary to make payment. If Kelly makes payment on time the transaction is voided. The enslaved are described: “…the following negroes to wit Polly, Charlotte, Mary Eliza, Jake, Margaret, Antonielo and Washington an infant all which are the children of the said Polly, also Calder the elder Calder, the younger Anthony Polly and Dan the child of Polly also Nance, Sarah Eliza, Rachael Isaac and Mary being children of the said Sarah…”.
