William Linen, the administrator of the estate of Thomas Harvey, recalls that he initiated a suit against Maj. Joseph Jenkins for the recovery of a slave named Smart. Asserting that said trial was a "sham," he brought suit against several lawyers, the deputy sheriff, and the foreman of the jury; however, the case was not admitted to court and Linen himself was jailed. Having "made my escape," the petitioner "humbly prays that the Judiciary should be brought to Justice in such a manner as you and your wisdom shall direct."
