- Salutation: To the Honorable Augustus B Longstreet One of the Judges of said State holding jurisdiction in Chancery in and for the Ocmulgee District
Abstract
Joseph Boren sues Nathaniel Howell by right of his wife, Mary Wagnon Boren. Mary's grandfather, Phillip Mallory, loaned a slave named Rose to Mary's mother, Elizabeth Wagnon, for her lifetime, to be distributed to Elizabeth's two daughters after her death. Nathaniel Howell, the husband of one of Elizabeth Wagnon's daughters, became the guardian for Daniel Wagnon, Elizabeth's husband, who became insane. Howell then controlled the property of the estate that included nineteen slaves who were comprised of Rose and her increase. Boren contends that Howell has not distributed the estate properly, and that he is entitled to a fair settlement. He asks the court to force Howell to inventory the estate and settle it.
Result: Denied; appealed; reversed.
